These terms apply to everyone who uses ShopLink SA — sellers who run online stores, and customers who buy from them. ShopLink SA is operated by ShopLink SA (Pty) Ltd (registration number Sole proprietor – not registered), 915 phumulani createst street (“ShopLink SA”, “we”).
1. What ShopLink SA is
ShopLink SA is software that lets independent sellers create an online store, take orders and get paid. We are not the seller. When you buy from a store, your contract of sale is with that seller, who is responsible for the goods, delivery, returns and refunds, and for complying with the Consumer Protection Act and the Electronic Communications and Transactions Act (ECTA). Payments for orders go directly to the seller's own PayFast account.
2. For customers
- Prices are in South African rand and include VAT where the seller is VAT-registered. The delivery cost is shown before you pay.
- Items are reserved for 30 minutes while you pay. If payment isn't completed, the order is cancelled automatically.
- ECTA gives you a cooling-off right to cancel most goods bought online within 7 days of delivery (you may pay the cost of returning them). Some items are excluded, such as perishable or personalised goods. The seller's own return policy is shown in their store and may give you more.
- For a problem with an order, contact the seller first (their details are in the store). If that doesn't help, use “Report a problem with this store” and we will look into it.
- Reviews must be honest and about your own purchase. No abuse, personal information about others, or links.
3. For sellers
- You must be at least 18 and able to enter contracts. The details you give us (business name, contact details, banking via PayFast) must be true and kept up to date.
- You are the supplier to your customers: you must describe goods accurately, send them on time, honour refunds and returns as the law and your policies require, and issue invoices. You are responsible for your own tax (including VAT and income tax).
- Subscriptions: plans are billed monthly in advance through PayFast after any free trial. You can cancel at any time and keep access until the end of the paid month. Failed payments have a 7-day grace period, after which your store is paused until payment succeeds. Prices may change with 30 days' notice.
- You may not sell illegal, counterfeit, stolen or dangerous goods, items that need a licence you don't have, weapons, drugs, or anything that infringes someone else's rights, and you may not mislead customers.
- You are responsible for the personal information of your customers that you receive through ShopLink SA and must use it only to fulfil their orders and as POPIA allows. Marketing is only allowed to customers who opted in.
- We may suspend a store that breaks these terms or the law, or that puts customers at risk, and will tell you why. Serious cases may be reported to the authorities.
4. Everyone
- Keep your password private; turn on two-step sign-in. Tell us straight away if you think your account was misused.
- Don't attack, overload, scrape or try to get around the security of the platform.
- The ShopLink SA name, logo and software belong to us. Sellers keep ownership of their own content and give us permission to show it in their store and to promote the platform.
- We work hard to keep the service available and secure but can't promise it will never be interrupted. To the extent the law allows, we are not liable for indirect losses, or for the acts of sellers, couriers or payment providers. Nothing in these terms limits rights you have under the Consumer Protection Act that can't be limited.
- We may update these terms; we'll tell sellers by email at least 14 days before important changes take effect.
- South African law applies. Contact: support@shoplinksa.co.za.
